Beavers Forest School Waiver & Participation Agreement
IMPORTANT: PLEASE READ CAREFULLY BEFORE ENROLLING. ENROLLMENT CONSTITUTES AGREEMENT TO ALL TERMS AND CONDITIONS BELOW.
1. Definitions

Organization: Beavers Forest School, a nonprofit educational organization.

Parent–Child Gatherings: Cooperative, outdoor educational experiences where parents/guardians remain responsible for supervision of their child(ren).

Homeschool Drop-Off Program: Structured, mentor-supervised educational experiences for enrolled homeschooled children, starting Fall 2025.

Participant(s): Any child or adult enrolled in, attending, or participating in Organization activities.

Mentor(s): Adult facilitators provided by the Organization to support program activities.
2. Program Supervision

Parent–Child Gatherings: Parents/guardians are solely responsible for the supervision, safety, and behavior of their child(ren) at all times. Mentors provide guidance and facilitation only.

Homeschool Drop-Off Program: Participants are under the supervision of Organization mentors during program hours. Parents/guardians are responsible for transportation to and from program locations.
3. Assumption of Risk
I understand that participation in Organization activities, including but not limited to hiking, climbing, creek exploration, shelter-building, plant identification, water activities, and use of natural tools and materials, involves inherent risks, dangers, and hazards, which may result in serious injury, illness, or death. These risks include, without limitation:

Uneven, slippery, or unstable terrain

Adverse weather conditions (heat, cold, rain, wind, snow)

Exposure to plants, insects, and wildlife

Physical exertion, falls, collisions, and scratches

Use of natural materials or tools provided by the Organization
I acknowledge that it is impossible for the Organization to eliminate all risks. By enrolling, I voluntarily assume all risks associated with participation, including risks not specifically listed above.
4. Release of Liability, Waiver, and Indemnification
In consideration for participation, I, on behalf of myself, my child(ren), my heirs, representatives, executors, administrators, and assigns, hereby release, discharge, and hold harmless Beavers Forest School, its mentors, volunteers, officers, directors, landowners, affiliates, successors, and assigns from any and all liability, claims, demands, causes of action, or expenses (including attorneys’ fees) arising from any injury, death, property damage, or other harm sustained during or related to participation, except in cases of gross negligence or willful misconduct.
I further agree to indemnify and hold harmless the Organization from any claims, damages, or losses brought by any third party arising out of my or my child(ren)’s participation.
I expressly waive the protections of California Civil Code §1542, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release…”
This waiver applies to all known and unknown claims.
5. Transportation
For the Homeschool Drop-Off Program, parents/guardians are responsible for transporting participants to and from program locations. The Organization is not responsible for any accidents, injuries, or incidents that occur during transportation.
6. Medical Authorization and Emergency Care
I authorize the Organization and its representatives to secure emergency medical treatment for my child(ren) if deemed necessary, including first aid, CPR, and transport to a medical facility. I agree to assume all costs associated with such treatment. I release the Organization from any liability for injuries, illness, or medical expenses arising from emergency care.
I affirm that my child(ren) has no medical, physical, or psychological condition that would prevent safe participation, or I have disclosed all relevant conditions in writing. I will provide emergency contact information, allergy information, and any special medical instructions as requested by the Organization.
7. Consent for Hazardous Activities
I acknowledge that my child(ren) may participate in activities that include natural terrain exploration, climbing, creek or water interaction, and use of tools or materials found in nature. I understand the risks and consent to my child(ren)’s participation in such activities.
8. Media Release & Privacy
I grant permission for photographs, video recordings, and other media containing images of my child(ren) to be used for educational, promotional, or marketing purposes. I understand that children’s identifiable images will not be sold or distributed to third parties.
Parents/guardians may opt out in writing to prevent use of their child(ren)’s identifiable image. Group photos or images where children are not identifiable may still be used.
9. Conduct, Bullying, and Safety
I agree to support a safe, respectful environment. The Organization reserves the right to remove participants for conduct that jeopardizes safety, violates rules, or is disruptive. No refunds will be issued in such cases.
10. Governing Law and Venue
This Agreement is governed by the laws of the State of California. Any disputes arising from this Agreement shall be resolved in the courts located in Shasta County, California.
11. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
12. Acknowledgment of Nonprofit Educational Status
I understand that Beavers Forest School is a nonprofit organization providing private-school-like instruction for homeschooled children and cooperative parent-child gatherings. It is not licensed childcare. Supervision responsibilities differ depending on the program:

Parents/guardians are fully responsible during Parent-Child gatherings.

Mentors supervise children in the Homeschool Drop-Off Program.
13. Agreement
By enrolling, I certify that I have read, understood, and voluntarily agree to all terms, including assumption of risk, release of liability, indemnification, medical authorization, transportation responsibility, hazardous activity consent, media release, conduct expectations, and governing law provisions.
This Agreement is binding upon me, my child(ren), my heirs, executors, administrators, and assigns.
